    THIS SHORT-LET AGREEMENT is entered into on the

    Between

    FUNDVINE PROPERTIES LTD (Owners of Mabel Court Apartments)
    A company registered under the laws of the Federal Republic of Nigeria, with its address at 5, Idowu Taylor Victoria Island, Lagos, of the ONE PART

    And

    of

    (hereinafter called "Guest”) of the OTHER PART.

    Fundvine Properties and the Guest shall individually be referred to as “Party” and jointly as “Parties”

    WHEREAS:

    • Fundvine Properties Ltd is the beneficial owner of all that fully serviced and furnished property, lying, being and situate at Amusa 4 Building, 14 Ladipo Latinwo Crescent, off Admiralty Road, Lekki Phase1, Lekki, Lagos (Hereinafter referred to as “The Apartment”).

    • The Guest is desirous of renting the Apartment on a short term basis, and Fundvine Properties has agreed to let to the Guest the said Apartment, upon the terms and conditions hereinafter stated in this Tenancy Agreement.

    • Both parties herein agree to the following terms and conditions of this Agreement.

    In consideration of the rent herein reserved and of the covenants hereinafter contained, the Fundvine Properties hereby lets unto the Guest the Apartment, the parties hereby agree follows:

    • Property: The apartment to be leased is located at Amusa 4 Building, 14 Ladipo Latinwo Crescent, off Admiralty Road, Lekki Phase1, Lekki, Lagos.

    • Maximum Occupancy: The maximum number of guests is limited to 2 (two) persons for each bedroom and, 6 (six) persons for the entire apartment.

    • Terms and Duration: The short-let shall begin at ________________and end at _______________
    • Rental Rules: All the guests agree to follow all the short-let rules at all times while at the apartment and shall cause all members or their visitors to abide by the rules at all times while within the premises.

    • Disclaimer: Fundvine Properties Ltd having stated the security and live-in protocols in the house rules shall not be deemed responsible for any damages, illnesses, or injuries that occur while on the property or its facilities. Consequently, Fundvine Properties shall not be liable for any loss of personal belongings or any valuables to the guest.

    • Access: All the guests shall allow Fundvine Properties or its representative’s access to the property for purposes of Cleaning, repairs and, Inspection while this agreement subsists. The management shall exercise this right of access in a reasonable manner.

    • Rate and Fees: All payments due must be confirmed before check-in. The guest shall make a payment of _______________ as the daily rate for the short-let, subject to a discount at the discretion of Fundvine Properties for long term stays. The Guest shall also make a payment of ___________ as Caution Fees, which shall be refundable upon the expiration of the tenancy.

    • Cancellation Policy: Fundvine Properties operates a no refund policy. Should the guest wish to cancel his/hers/their reservation, all payments to the exclusion of the refundable caution fees, shall be forfeited if canceled _______________ days before the check-in date.

    • Refunds: there shall be no refunds or partial refunds due to weather conditions unless otherwise, subject to the discretion of Fundvine Properties.

    • Departure: The guest shall leave the property in a clean and decent condition.

    GENERAL PROVISIONS

    • INDEMNITY
    Notwithstanding anything apparently to the contrary in this Agreement, the Guest shall indemnify and hold harmless Fundvine Properties, including its affiliates, directors, officers, employees, and representatives in full, from and against any third-party claims, losses, reasonable attorneys’ fees, damages, liabilities, costs, expenses, or suits for injury to any person, damage to or loss of property or any part of it, or any other claim directly arising out of and to the extent attributable to:
    • The negligence or act, misconduct or omission of the Guest,
    • The Guest’s breach of any of his/her obligations under this agreement.

    • KEYS AND FURNITURE: Any and all keys and furniture to and in the Apartment shall be surrendered to Fundvine Properties on the termination or expiration of this Agreement.

    • Nothing contained in this Agreement shall be interpreted as creating a partnership, joint venture, or relationship of principal and agent between the Fundvine Properties and the Guest, it being understood that the sole relationship created hereby is one of Fundvine Properties and Guest.

    • AMENDMENT, MODIFICATION, OR WAIVER: No amendment, modification, or waiver of any condition, provision, or term of this Agreement shall be valid or of any effect unless made in writing, signed by the party or parties to be bound, or its duly authorized representative, and specifying with particularity the extent and nature of such amendment, modification, or waiver. Any waiver by any party of any default shall not affect or impair any right arising from any subsequent default.

    • SEVERABLE PROVISIONS: Each provision, section, sentence, clause, phrase, and word of this Agreement is intended to be severable. If any provision, section, sentence, clause, phrase or word hereof is illegal or invalid for any reason whatsoever, such illegality or invalidity shall not affect the validity of the remainder of this Agreement. Parties shall however negotiate a similar but valid and legal provision in replacement of the said invalid provision.

    • ENTIRE AGREEMENT: This Agreement contains the entire understanding of the parties hereto with respect to the transactions contemplated hereby and supersedes all prior agreements and understandings between the parties with respect to such subject matter.

    • This Agreement shall be construed and enforced in accordance with the laws of the Federal Republic of Nigeria. No provision of this Agreement shall be construed by any court against either party by reason of such party being deemed to have drafted or structured such provision

    • PERSONAL GUARANTEE: The Guest confirms that the persons put forward as her guarantors are of good standing and are in a good position to fulfill their respective obligations to the Fundvine Properties under the Guarantee executed by each of them. The Guest warrants that none of the Guarantors were coerced, unduly influenced or forced into signing the said Guarantee.

    1. ENTIRETY
    This Agreement shall be deemed to be the entire Agreement between the Parties and shall supersede previous arrangement, correspondences or communication between them.
